LaPaDD Europe General Terms & Conditions

LaPaDD would like to draw your attention to the present General Terms and Conditions which govern product orders made from the LaPaDD online store.

The LaPaDD Store allows any person to order registered products (hereafter referred to as “Products”) from the LaPaDD Product catalog through LaPaDD, a company governed by French law. Its registered office is based at: 30, rue du Plateau, 92500 Rueil-Malmaison, France.

 

1. ORDERING PROCESS

Your order is confirmed when you click on the "Order" button after entering your coordinates as well as your address.

2. ORDER CONFIRMATION

An e-mail confirming your order will be sent to you within 24 hours of your order confirmation. This email contains a complete summary of your order as well as the reference of the transaction. This is your proof of purchase and should be kept in case you wish to make a claim.

LaPaDD does not systematically sends an invoice. If you wish, we can send you an invoice : please send us a request to info@lapadd.com.

3. PRICES

All orders are payable in euros, regardless of origin.

Prices displayed are tax inclusive in euros, and exclude delivery charges for physical products and tax deduction at source, which are charged to the debtor according to the financial regulations of certain countries.


Customs duties, other import duties and/or local and central government taxes may be imposed. LaPaDD accepts no responsibility for these duties and taxes. As the customer, these are charged to you, and are your responsibility entirely, as regards both declaration and payment to the relevant authorities and/or bodies in your country.

LaPaDD reserves the right to change prices at any time, but orders will be invoiced based on those prices displayed when the purchase order was made.

4. PAYMENT AND SECURITY OF TRANSACTIONS

Payment is due as soon as the order has been made.

Payment can be made either by bank transfer (with mail or e-mailing proof of payment), check (goods will be sent upon receipt of payment), online by Paypal or by credit card CB / Visa or Mastercard.

LaPaDD uses a financial transaction security system implemented by a specialist service provider, Ogone. Only Ogone knows your credit/debit card details and this data is transmitted in secure SSL 128-bit encrypted format.

5. PRODUCT AVAILABILITY

All products are on offer while stocks last, provided they are displayed on the LaPaDD Store. Out of stock products have a « not available » comment and cannot be ordered

If an ordered product is not available, you will receive telephone or e-mail notification within 48 working hours after your order confirmation, informing you of a new delivery date.

6. PRODUCT DELIVERY

Products are delivered to the delivery address provided during the ordering process.

They are sent by express parcel mail.

Delivery times can vary between 48 working hours and 5 working days after you have confirmed your order, depending on the delivery address. Deliveries to countries outside the European Union may be significantly longer due to Customs formalities and controls.

You are asked to provide a phone number when completing your order so that the delivery carrier can contact you in case of delivery problems.

In case of non receipt or receipt of damaged products, please contact our customer service by email at info@lapadd.com.

LaPaDD will process and send your order within 7 business days from the date of your payment.

7. RETURNS POLICY

In accordance with the terms of Article L.121-20 of the French Consumer Code, you have seven (7) working days from when you receive your ordered products to exercise your right to return without providing a reason or being subject to a financial penalty.


Your right to return your Product is however subject to the following conditions:

  • The products must be returned intact in their complete original packagings and in perfect condition (including, if relevant, accessories, user manual, etc.) along with your RMA-number within seven (7) working days of receipt of your order
  • Products returned incomplete, damaged, broken or soiled will not be accepted. 
  • Return delivery costs are the responsibility of the customer. 
  • Only the price of the purchased Product(s) will be reimbursed (delivery costs are the responsibility of the customer).


Please note that in order to ensure good management and follow-up on your product return, you are asked to, within seven (7) days of receipt of your order, contact the LaPaDD Customer Service at info@lapadd.com. LaPaDD will issue a RMA-number. Please write this RMA-number on the packet and send it back to :

Your credit card/bank account will be reimbursed within thirty (30) days following receipt of your product(s) by LaPaDD.

 

8. LIMITATION OF LIABILITY

The greatest care is taken in selecting, creating and dispatching our products.

However, handling errors, caused especially by the local environmental conditions, may occur by virtue of the use of products.

As a result, LaPaDD cannot be held responsible for those handling errors.

The products comply with French legislation and standards applicable in France. LaPaDD can not be held responsible for non-compliance with the legislation of the country where the product is delivered.

To the extent provided for by applicable regulations, LaPaDD and/or its suppliers are under no circumstances responsible for indirect damages caused to you, including, for your information but not exclusively, loss of earnings or profits, loss of business, loss of data and loss of software and hardware, including recovery, reproduction and repair costs and aforementioned losses, resulting from the use and/or impossibility of using the products.

9. WARRANTY

All orders made from the LaPaDD Store are protected by contractual warranties if the product is defective

To benefit from the contractual warranty, you must contact LaPaDD Customer Services (info@lapadd.com) by email or by telephone within ninety (90) days of receiving the Product, indicating your product reference number and providing a detailed description of the defect or abnormality, the circumstances surrounding its occurrence, and its symptoms.

LaPaDD Customer Services will provide you with a RMA number which you must obtain before you return the product. Failure to get a returns reference number before returning the Product will result in no refund being issued. Under all circumstances, return delivery costs are your responsibility.

You will then return the complete product with all components delivered (product, manuals ...) and the RMA number to LaPaDD SARL, 30 rue du Plateau, 92500 Rueil-Malmaison, France.

LaPaDD will either refund or replace the defective product. In case of refund, the product and delivery costs will be reimbursed based on the rate charged on delivery. In any event, the cost of return will be your responsibility.

LaPaDD ensures product specifications given on the packaging of the product and the description online shop LaPaDD, to the exclusion of all other warranties, implicit, explicit, merchantability or fitness to a use or a specific configuration.

In addition, the contractual guarantee does not cover:

  • abnormal use or non-compliant products, please consult this regard carefully the instruction manual provided with the products
  • defects and their consequences related to any external cause.

11. PROTECTION OF PERSONAL DATA

LaPaDD is committed to your privacy and will not to pass on your personal data to any third parties. Your data is confidential and is used exclusively to process and follow up your order, inform you of products related to those you have ordered, which are created or sold by LaPaDD, and to inform you of promotional offers, unless you indicate otherwise when making your order.

In addition, and in accordance with French legislation in force (Art. 34 of the "Informatique et Libertés" law of 6 January 1978 (Law on Information Technology and Freedom”)), you are authorised to access, modify, correct and delete your personal data. To exercise this right, please send us an email to info@lapadd.com. If you wish to delete or close your account, please send us an email to info@lapadd.com.

12. APPLICABLE LAW - JURISDICTION

The General Terms and Conditions laid down in the present document are governed by French jurisdiction, irrespective of French regulations relating to conflict of laws.

Any disputes concerning the execution or interpretation of the present General Terms and Conditions will be referred to the Tribunal de Commerce (Commercial Court) at Nanterre in France.

 

APPENDIX 1

Article L211-4 (inserted by Order No. 2005-136 of 17 February 2005 Article 1 Official Journal of 18 February 2005)

The seller is required to deliver a product which conforms to the contract and is held liable for any lack of conformity which exists upon delivery.

He is also held liable for any lack of conformity caused by the packaging or the assembly instructions, or the

installation if he assumed responsibility therefor or had it carried out under his responsibility.

NB: Order 2005-136 2005-02-17 Article 5: The provisions of the present order shall apply to contracts concluded subsequent to its entry into force.

Article L211-5 (inserted by Order No. 2005-136 of 17 February 2005 Article 1 Official Journal of 18 February 2005)

To conform to the contract, the product must:

1. be suitable for the purpose usually associated with such a product and, if applicable:

  • correspond to the description given by the seller and have the features that the seller presented to the buyer in the form of a sample or model
  • have the features that a buyer might reasonably expect it to have considering the public statements made by the seller, the producer or his representative, including advertising and labelling;

2. or have the features defined by mutual agreement between the parties or be suitable for any special requirement of the buyer which was made known to the seller and which the latter agreed to.

Action resulting from lack of conformity lapses two years after delivery of the product.

NB: Order 2005-136 2005-02-17 Article 5: The provisions of the present order shall apply to contracts concluded subsequent to its entry into force.

 

Article 1641 Civil Code

The seller shall provide warranty against hidden defects in the thing sold which render it unfit for the purpose for which it was intended, or that decrease this use to such an extent that the buyer would not have acquired it, or would have paid a lower price if he had known about them.

 

Article 1648 Civil Code

Proceedings resulting from latent defects must be brought by the purchaser within two years from the discovery of the defect.
